FSI in Maharashtra

The Floor Space Index is a fundamental tool of urban planning in Maharashtra which is used to guide the development and ensure sustainable growth. The revised guidelines of July 2023 continue to emphasize a balanced approach, maintaining the basic FSI while allowing for enhancements based on road infrastructure, reflecting the state’s commitment to thoughtful urban planning. The Municipal Corporation of Greater Mumbai (MCGM) and other local municipal bodies in Maharashtra oversee the implementation of FSI regulations. These bodies periodically revise FSI norms based on urban development needs and policy changes. This article highlights the present FSI in Maharashtra.

Revised FSI for Leasehold Property (MIDC) in Maharashtra as per the CDCPR 2023

FSI on the Leasehold Property has three aspects:

In-Suit FSI (Basis FSI): The Basic FSI for all type of buildings in Maharashtra is one. For instance on a 1000 Sq Mtrs of plot 1000 Sq Mtrs of Construction is allowed.

Additional FSI: Additional FSI depends on the road width in front of the plot. MIDC charges premium for the purchase of additional FSI. The table placed below showcase the Additional and the total permissible FSI in Maharashtra. (Basic Plus Additional):

Ancillary FSI: Common Areas such as lift lobbies, staircases, flower beds, watchman cabin, servant quarters, garage store rooms, pump rooms, covered parking etc. are considered an ancillary area. FSI consumed in these areas is known as Ancillary FSI. In additional to the permissible FSI (Basic and Additional FSI). 80% of the total permissible FSI in the form of Ancillary FSI can be availed by paying premium in case of Industrial and Commercial Use, and 60% in case of Residential Use. The applicable premium for the purchase of Ancillary FSI is 10% of the prevailing MIDC rate.

NOTE: Additional Premium can be purchased on the requirement basis.

Government of Maharashtra vide is notification dated 12th January 2024 has made alteration in applicable FSI for IT/ITES Industry in Maharashtra. MIDC vide its circular No: MIDC/CP/P-172380/2024 has declared the applicable FSI for IT/ITES would be as per the IT Policy 2023. The table below showcase the Maximum FSI for the IT Sector:

Premium on Purchase of Additional FSI in Maharashtra

The land use is broadly categorized into three as Industrial, Commercial and Other. The rate of premium for purchase of additional FSI is different for all the three categories. The table placed below represents the applicable premium on additional FSI:

Premium for the purchase of Ancillary FSI is 10% of the ongoing MIDC Rate which is in addition to the premium applicable on purchase of additional FSI.

FSI on Freehold Property

FSI on the Freehold Property is 1:1 i.e. on the 1000 Sq Mtrs Plot 1000 Sq Mtrs of construction is allowed with a ground coverage of 50%.
